Conako Léman places great importance on the protection of your personal data. Here, we inform you about the data we collect and for what purposes it is used. Your personal data is protected as much as possible by appropriate technical and organizational measures. CONAKO Léman reserves the right to adapt this data protection statement. The date of the last update can be found at the end of this document. All personal data is processed in accordance with Swiss data protection law and the General Data Protection Regulation (GDPR) of the European Union, as well as all other relevant legal provisions. Unless otherwise specified, the terminology used corresponds to the terms defined by the law. For simplicity, the masculine form also includes the feminine form and vice versa.

Definition of Personal Data

Personal data is all information relating to an identified or identifiable natural person (e.g., name, first name, address, or date of birth). In principle, you can use the website without providing personal data. If the collection of personal data is necessary, this data protection statement provides the required transparency.

When is Personal Data Collected?

It is important to us that our customers or visitors to our website understand what personal data we process about them. Data collection may occur in the following places:

  1. Website in general: personal data is processed and collected through log files, cookies, analytics tools, social media plugins, or other providers;
  2. Newsletter or SMS services: subscribing to the newsletter or SMS services is based on your consent during registration;
  3. Contact form: When making contact (e.g., questions or suggestions), personal data is processed;
  4. Website account: For the creation of an account, personal data is collected based on your registration;
  5. User-generated content: Participation in forums or others may require the processing of personal data;
  6. Competitions: To participate in competitions, it is necessary to provide personal data;
  7. General business operations: As part of general business operations, we collect the necessary personal data.

Where permitted, we also collect personal data from public sources (e.g., the Internet, commercial register, debt enforcement register, or the press).

Purpose of Data Processing and Legal Basis

Firstly, personal data is only processed within the scope of our business activities (for example, conclusion and execution of contracts or general business operations). If we request consent for data processing, this consent serves as the legal basis (e.g., for newsletters). Furthermore, processing occurs to fulfill legal obligations. In addition, personal data may be processed for the following purposes, which correspond to our legitimate interest:

  1. Provision of the website, apps, or other platforms and the online offer for users (including extension or development);
  2. Maintaining commercial activity (e.g., IT environment, websites, and apps). This also includes security measures such as visitor checks or internal accounting;
  3. Optimization of websites, audience measurement, market research;
  4. Sending newsletters and/or advertisements, unless there is a duly expressed objection;
  5. Offer of SMS services
  6. For contact (e.g., suggestions and questions, media, or applications);
  7. Personalization of the online offer and customer acquisition;
  8. Conducting competitions;
  9. For data security reasons (this includes internal investigations);
  10. Requests or communication with third parties (e.g., applications, media requests);
  11. Exercise and defense of legal claims (including procedures with or against authorities).

Transmission of Personal Data

In principle, personal data is only transmitted to third parties with your consent or based on our legitimate interest. Generally, transmission occurs when certain services or benefits are provided by third parties (e.g., business partners, our service providers, or others). In addition, data may be transmitted internally or handed over to authorities. Our partners take the protection of your personal data as seriously as we do. Therefore, CONAKO Léman only chooses trustworthy partners who guarantee adequate protection of your data. Such collaboration only occurs according to our instructions, and no personal data is sold for marketing purposes. Transmission to third parties takes place, if necessary, within the framework of administrative or judicial orders to which we are obliged. In principle, data may be transferred to countries in which we or our service providers (e.g., server provision, etc.) are active. Where the destination country does not offer an adequate level of data protection, we protect ourselves through corresponding agreements or the exceptions mentioned in the law (e.g., with your consent).

Duration of Storage and Retention Periods

In principle, we only store personal data as long as required for the fulfillment of the storage purpose. Exceptions are the legitimate interest of the company in longer storage (e.g., for tax reasons or because a procedure is ongoing) or a legal retention period that obliges us to store the data. As soon as the purpose of the recording is achieved and there is no longer a reason to retain them, your personal data is immediately deleted or anonymized.

Rights of the Data Subject

The following rights are granted to data subjects:

  1. Right to information: you can request confirmation at any time about the personal data we process about you and whether it is transferred to a third country;
  2. Right to correction: you can demand that the personal data we hold about you be immediately corrected if it is inaccurate or completed;
  3. Right to deletion: you can request the deletion of your personal data if it is no longer necessary for the associated purposes or if other legal standards do not oppose their deletion;
  4. Right to restriction of processing: the right to restriction of processing exists insofar as (i) you dispute the accuracy of the data, (ii) the processing is unlawful, but you refuse their deletion, (iii) we no longer need the data, but you need it to assert, exercise, or defend legal rights, or (iv) you have objected to processing;
  5. Revocation of consent: you have the right to revoke any given consent for one or more specific purposes at any time, insofar as the processing is based on your explicit consent. This particularly applies to cases of direct advertising. Data processing carried out until the revocation is not affected.   6. Right to object: you have the right to object at any time, for reasons related to your particular situation, to the processing of personal data concerning you;
  7. Right to data portability: you have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, or to request its transmission to another controller.

Only clearly identified persons can assert the exercise of such rights. If your identity is not clearly established, we reserve the right to take measures to identify you (e.g., requesting a copy of your identity card).

You have the right to file a complaint with a supervisory authority. Generally, you can contact the supervisory authority of your usual place of residence, place of work, or the place of the alleged infringement. For Switzerland, the competent authority is the Federal Data Protection and Information Commissioner (FDPIC).

Obligation to Provide Personal Data

There is no obligation to provide personal data. Please note that certain parts of the website cannot be used if you refuse to provide personal data. Profiling and Automated Decision Making.

As part of technical analyses, your personal data is partially processed automatically (profiling). Such automated decisions are made only for evaluation purposes and serve market research or the personalization of offers (e.g., personalized advertising). No fully automated decisions are made in the course of usual business relations.
